GUIDLINES

Guidelines are part of the soft law, the legal basis of which is contained in Article 16 of EIOPA Regulation. In accordance with paragraph 3 of this Article, competent authorities and financial market participants should make every effort to implement the guidelines adopted by EIOPA. Competent authorities should comply with them by including them in their supervisory practices, including where specific guidelines are directed primarily at financial market participants. The guidelines build on key EU legislation in order to harmonize it in all Member States. After the Financial Supervision Commission takes a decision on the implementation of the guidelines, they become obligatory for the market participants in Bulgaria.
